Hereditary Health Guarantee: If within the first 1 year of the puppy’s life it is found to have any hereditary defect which impacts clinically on the dog’s quality of life, as certified by a qualified veterinarian, (the Breeder has the right to require a second opinion from a nominated veterinarian of Breeder’s choosing at the Breeder’s expense), the remedy clause outlined in this Agreement shall be applicable and considered the only remedy/compensation available to the Buyer. Health guarantee is null and void if puppy is not taken to licensed Veterinarian within 28 days of purchase and spayed/neutered within one year of age.
This Hereditary Health Guarantee does not cover or warranty against viral or bacterial illnesses and does not include or cover accidental physical injury or any digestive system related illness such as giardia, coccidiosis or cryptosparidious, which can commonly and readily be contracted by dogs of all ages through the ingestion of unclean or contaminated water, or eating such things as sticks, rocks, dirt, spoiled food, animal feces, rodents, etc. Additionally, this health guarantee does not cover illnesses that develop due to the ingestion of foreign objects, chemicals, poor diet or the onset of physical or mental stress.
Remedy: If it becomes necessary to replace a dog or to seek a remedy due to a health problem, the Buyer agrees to choose one of the following remedies.
1) The Breeder will replace a puppy of equal value. When choosing this remedy, the Buyer is required to return the dog to the Breeder at Buyer’s expense. It is understood that there may not be a replacement puppy available at the time of request, therefore the Breeder is given up to 12 months to satisfy this remedy.
2) The Breeder will reimburse the Buyer in the amount of 100% of the original purchase price of the puppy. It is understood that reimbursement is defined as the Breeder giving back to the buyer 100% of the original sale price of the puppy, not including costs of shipping or training. When choosing this remedy, the Buyer is required to return the dog to the Breeder at Buyer’s expense.
Canine Disposition Statement: The Breeder cannot guarantee color, size, temperament or whether the puppy will shed or not shed or be hypoallergenic. These can only be estimated and can always change or differ and are ultimately outside of the Breeder’s control.
Limitations: Contract is null if puppy is not seen by a licenced veterinarian within the first 48 hrs after pickup.
